Please read carefully and fully understand each clause before using Tina Live, especially the clauses of exemption or limitation of liability, restrictions on minors, etc. Restrictions, exemption of liability clauses or other clauses involving your major rights and interests may be highlighted in bold to remind you to pay special attention.
Tina Live provides services to adults aged 18 or above (or the age of majority stipulated by your local laws). If you are under 18 or do not meet the age of majority required by local laws, please stop using our products and services immediately. If you, as a guardian, find that the minors under your guardianship are using our products and services, please notify us in time and we will respond and handle it in a timely manner.
You should comply with local laws and regulations and respect local ethics and customs when using the services provided by Tina Live. If your behavior violates local laws and regulations or ethics, you shall bear the responsibility for it independently. You should avoid involving us in public events due to the use of Tina Live services, otherwise Tina Live has the right to suspend or terminate the provision of services to you and promptly cooperate with all investigations and inquiries by the competent authorities; at the same time, we reserve the right to seek compensation from you.
The "Tina Live's Terms and Conditions", "Tina Live's Privacy Policy", "Tina Live Child Safety Policy" and other agreements that Tina Live has released , as well as future new agreements and rules, are an integral part of this Agreement and together constitute the complete version of this Agreement. We encourage you to review them in a timely manner and read them carefully.
This Agreement is signed by Tina Live (hereinafter referred to as "we" or "us" or "our") and the user of Tina Live (hereinafter referred to as "user" or "you"). If you use Tina Live, we believe you that you have fully understood this Agreement and agree to abide by it. If you disagree with this Agreement, it will result in us being unable to provide you with services,then please stop using Tina Live immediately.
Tina Live may modify and update this Agreement from time to time. The updated Agreement will be brought to your attention by appropriate means such as in-site messages. If you do not agree to the modified terms, please immediately stop using the relevant services. If you continue to use it, it will be deemed that you have understood and accepted the modified Agreement.
We provide a registration channel for Tina Live accounts. You can choose to register a Tina Live account by email. You can also use the third-party platform account authorization login function we provide to register and log in to Tina Live through the user account of the third-party software or platform that you legally own. You should ensure that the user account of the third-party software or platform you use complies with the requirements of relevant laws and regulations.
We do not provide account registration services to minors. If you are a minor, please stop registering and using your account immediately. Otherwise, once discovered, we will immediately take action against the account, including but not limited to suspending services to the account, banning the account, etc.
In order to better provide you with Tina Live social services and build a real Tina Live interactive community, we recommend that you provide us with real and valid information during the registration process, such as your profile photo, age and gender. You guarantee that you will not provide any false personal information. If the information you submit is inaccurate, untrue, illegal, or we have reason to believe that the above information is doubtful, we have the right to require you to correct, supply, and to refuse to provide you with related services. However, you understand and agree that for security reasons, you may not be able to modify the initial registration information and other verification information.
You acknowledge and accept that your Tina Live account is for your own use only. You are prohibited from giving, lending, renting, transferring, selling or otherwise permitting others to use the account. If we have reasonable grounds to believe that the user is not the account registrant, we have the right to suspend or terminate the service to the account to protect account security.
You shall maintain the security and confidentiality of your Tina Live account and password. If you lose your account or forget your password, you can apply to retrieve your account or password in a timely manner in accordance with our appeal channels. You understand and acknowledge that we only identify whether the verification information provided by the appellant in the appeal is consistent with the system records, and cannot identify whether the appellant is the real owner of the account. If your account is stolen or your password is lost due to your own reasons, such as improper custody, the corresponding losses will be borne by you. If you find that someone else is using your Tina Live account without permission, or find any other security loopholes, please notify us immediately and take measures such as changing your password to protect the security of your account.
To delete your data please click within the App on Settings located in the top right corner of your profile > click on "Setting"> select the option "Delete Account" > click on "Delete Account."
Account Disposal: If you violate this Agreement and local laws or engage in any other behavior that is deemed dangerous by Tina Live, Tina Live has the right to take emergency measures against your account without prior notice. Measures include but are not limited to restrictions, bans, freezes, etc. If this results in you being unable to use your account normally, you will be solely responsible for the risks caused by your dangerous behavior.
Tina Live is committed to providing a civilized, rational, friendly, and high-quality communication space. When you use Tina Live to publish voice, text, video and other content, you know and confirm that you may not publish the following content:
• contains profanity or language that may be considered offensive, harassing, disturbing, embarrassing, alarming or annoying to any other person;
• that is obscene, pornographic, or otherwise likely to infringe upon human dignity;
• that is abusive, insulting or threatening, or that promotes or encourages racism, sexism, hatred or bigotry;
• encourage any illegal activity, including but not limited to terrorism, incitement to racial hatred, and hate content;
• contains defamatory statements;
• related to commercial activities (including but not limited to sales, competitions and advertisements, any links to other websites or pay phone numbers);
• involves the transmission of "Junk mail" Or "Spam";
• contains any spyware, viruses, corrupted files, worms or other malicious code designed to interrupt, damage or limit or destroy the functionality of any software, hardware, telecommunications, network, server or other equipment, trojan horses or any other material designed to damage, interfere with, misappropriate or expropriate any data or personal information, whether from tina live or otherwise;
• the content or its publication infringes upon the rights of any third party (including but not limited to intellectual property rights, privacy rights, and portrait rights);
• indications of drug or substance use;
• display political content;
• contains sexual harassment or sexual innuendo;
• any content involving violence and/or self-harm, or encouraging or inducing others to participate in dangerous activities that may cause personal injury or death.
• display any information about minors, such as videos or voices of minors, inappropriate interaction targeted at a child (for example, groping or caressing) ;
• although it does not contain information about minors, it may have the potential to lead to bad consequences such as abuse, sexual abuse, seduction, or inappropriate content of minors;
• related to gambling, abortion, weapons or other highly explosive items;
• content related to underage dating;
• content related to compensated companionship, dating, or sexual acts;
• content that provides exploitative dating, mail-order spouse, deceptive dating, etc.;
• content that provides hook-up dating, fling, or swinger dating, affair dating or infidelity services;
• provide the content of sexual fetish dating;
• display live or chat content that contains nudity, partial nudity or sexually suggestive content;
• any other content that tina live determines to be negative or inappropriate in accordance with any applicable laws.
You promise that you are able to spend money independently according to local laws.
• When you use Tina Live, you may use Tina Live paid services (such as live broadcast rewards). For paid services, you need to use third-party payment tools accepted by Tina Live to complete the payment. When using third-party payment tools to make payments, you must also comply with the third-party's service rules and complete online payments in the methods and currencies accepted by the third-party payment tools.
• Generally, all purchases are final and nonrefundable, and there are no refunds or credits for partially used periods, except if the laws applicable in your jurisdiction provide for refunds. Special terms for refunds apply in the EU, EEA, UK, Switzerland, Korea, and Israel.
• When you make a payment, these third-party payment tools may require you to provide certain information in order to make the payment through their financial institutions and comply with applicable international, national, federal, state and local laws and regulations.
• You understand and agree that we cannot guarantee the security, accuracy, effectiveness and timeliness of third-party payment tools, nor can we provide any guarantee for third-party payment tools. We do not assume any responsibility for any disputes or losses caused by your use of third-party payment tools.
• You understand and confirm that, based on the characteristics of Internet products, we will provide you with paid services, such as membership services, virtual props, etc. Once the transaction is completed, such payment cannot be revoked, refunded, or reversed.
• The payment service you purchase is limited to the use of the legitimate purpose of the service and must always comply with all applicable laws. For example, virtual props (such as diamonds, coins, etc.) cannot be traded, cannot be exchanged for the legal currency of any country or region, and cannot be used for any form of investment or transfer.
• You guarantee that the source of funds for purchasing paid services is legal and compliant.
Our Products are protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. Our Products include trade secrets and information that is confidential and proprietary to us and you agree to take all necessary actions to protect the confidentiality of such information. All ownership rights in the Products, including any related documentation and any new releases, modifications, and enhancements thereto, belong solely to us or our licensors, if any, including all intellectual property rights therein. The App is licensed to you, not sold. Except as provided in these Terms, you shall not obtain any rights, title or interests in them, and shall not modify, copy, rent, lease, loan, sell, distribute or create derivative works based on them (either in whole or in part). There is no implied license, right or interest granted in any copyright, patent, trade secret, trademark, invention or other intellectual property right subsisting in the App and/or Services. We hereby expressly reserve all rights in the App and all Services, which are not expressly granted to you hereunder.
Subject to your compliance with these Terms, we grant you a personal, limited, non-commercial, non-exclusive, non-sublicensable, non-assignable, revocable license to download, install and use one (1) copy of the App, in object code format, only on your personal computer or mobile device (the "Device") for the sole purpose of your personal use of the App and any other applications that may be explicitly authorized by us for use through the App as permitted by these Terms.
By submitting, posting or displaying Content on or through the Products, you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute such Content in any and all media or distribution methods now known or later developed (for clarity, these rights include, for example, curating, transforming, and translating). This license authorizes us to make your Content available to others who may do the same. You agree that this license includes the right for us to provide, promote, and improve the Products and to make Content submitted to or through the Products available to other users, companies, organizations or individuals for the broadcast, distribution, promotion or publication of such Content on other media and services – for example our Apps and Services, subject to our terms and conditions for such Content use. Such additional uses by us, or other companies, organizations or individuals, is made with no compensation paid to you with respect to the Content that you, transmit or otherwise make available through the Products as the use of the Products by you is hereby agreed as being sufficient compensation for the Content and grant of rights herein.
You may terminate your use of the App and or Services at any time by deleting your account.
Without limiting any other remedies, we may limit, suspend, discontinue or terminate these Terms, your account and/or your use of all or any part of the App and/or Services, with immediate effect, automatically, with or without notice, if we believe that you are or may be:
• In breach of any of the terms of these Terms;
• Causing, or threatening to cause us to incur any legal liabilities (actual or potential);
• Delinquent with respect to any charges due for a Premium Service and/or any paid Content and items;
• Infringing a third party’s intellectual property rights or personal rights or performing any forbidden activity listed under Article 3;
• Engaging in prohibited behaviours, including but not limited to child abuse, prostitution, pornography, discrimination based on age, sex, gender, ethnicity, nationality, profession, political stance, religion, scamming, consumption of illegal drugs or substances.
We reserve the right at our discretion to make changes to this Privacy Policy from time to time. You may review updates to our Terms and Conditions at any time via links on our Site. You agree to accept electronic communications and/or postings of a revised Privacy Policy on the Site, and you agree that such electronic communications or postings constitute notice to you of the Privacy Policy.
